Terms of service

Terms of service shown here (hereinafter referred to as “terms”) are terms between HiRich Interactive Company Limited (hereinafter referred to as “service provider“) and the person who agrees to use the service provider’s service by registering using methods provided by the service provider (the person will be hereinafter referred to as “user”). The terms constitute partial or total use of HiRich Club website (hereinafter referred to as “service). Using of the service will signify the user’s agreement to the terms. Please read carefully.

1.  Terms and conditions agreement

1.1  All users must comply with the conditions in terms of service. The user must not use the service before agreeing to terms of service. The terms are effective and cannot be revoked.
1.2  Minors can use the service only after receiving consent of their parents or legal guardians. If the user uses the service on behalf of a juristic person or for the purpose of its business organization, it is assumed that the juristic person and the business organization also agree to the terms of service and the agreement cannot be revoked.
1.3  By using the service, the user signifies his/her agreement of the terms of service. The terms will be effective immediately and cannot be revoked.

2. Modification of terms and conditions

The service provider may revise or add to any of the terms and conditions applicable to the service where the service provider deems suitable, in order to observe the modified law or change the service offered by the service provider, without prior notification to the user. The user is advised to revisit the terms and conditions regularly when using the service. The modification will take effect immediately and the user’s use of service after such modification constitutes the user’s agreement to the modified terms and conditions. If the user does not agree to the modified terms and conditions, the user shall stop using the service immediately.

3.  Registration/ Account

3.1  The user agrees to give accurate, current and complete information when registering for the service. If the user gives inaccurate, dated or incomplete information or the service provider suspects on reasonable grounds that the information given is inaccurate, dated or incomplete, the service provider has the right to suspend the service or terminate the account immediately.
3.2  When registered, the user will receive HiRich Club ID and password (the user may change the password later).  The user must understand that the user is the sole person who is responsible for his/her HiRich Club ID and password. The service provider will not be liable for the loss of ID and password or any damage that may occur as a result of unauthorized use of the HiRich Club ID and password. If the HiRich Club ID or password is stolen, it is the user’s responsibility to change the password to secure the user account and retain its functionality.
3.3  The service provider may delete the user account without prior notice if the service provider believes that the user will violate the terms and conditions.
3.4  The service provider reserves the right to delete the account that has been idle for more than 1 year from the last date of use without prior notice.  
3.5  The user’s rights to use the service will expire when the user account is deleted regardless of the reason of deleting. The account cannot be restored.
3.6  Transferring, lending or selling the account to any third party is prohibited.

4. Privacy
The service provider assures the user that the service provider will protect the user’s privacy and personal information as stated in Privacy Policy.

5. Services of business partners
Content or other services which are provided by the service provider’s business partners may be included in the service. The business partners will be responsibility for all the content and/or services they provide. Furthermore, the content or services may be governed by explicit business partnership conditions.

6. Modification of the end of service
6.1  The service provider reserves the right to limit the user’s rights to use the service e.g. current member status, validity and other identification cards.  
6.2  The service provider reserves the right to provide advertisement of the service provider or of a third party via the service.
6.3  The service provider reserves the right to modify, suspend, or terminate the service either partially or entirely anytime without the need to notify the user in advance. The service provider will not take responsibility for the modification, suspending or terminating the service to the user. 
6.4  The service provider does not guarantee that the service (including the content) will have no flaw, both de facto and de jure flaws (including but not limited to stability, reliability, accuracy, morality, efficiency, suitability of purpose, faults relating to security system, errors, bugs, rights violation). The service provider will not take responsibility for flawed service.
6.5  The service provider will use the measure the service provider deems suitable and appropriate if the service provider is aware that the user is using the service in the way that violates the terms and conditions. However, the service provider does not guarantee other users and/or other third parties that other users and/or other third parties will not violate terms and conditions. Furthermore, the service provider does not take responsible for protection or remedy of the damage caused by the user’s violation to other users or other people.

7.  Withdrawal or cancelling of the service

7.1  In the case that the user has registered to and withdrawn from the service, any of the user’s personal information retained by the service provider will be protected according to the Privacy Policy.
7.2  The service provider may suspend or delete the user account without prior notification if the service provider is aware of the possibility that the user may violate terms and conditions.

8.  Announcement and contact

8.1  When the service provider announces or contacts users about the service, the service provider may do so via the methods the service provider deems suitable, for example, making an announcement on the webpage provided by the service provider or making an announcement using user account of the service provider’s service staff.
8.2  If the user wishes to contact the service provider about the service, the user may send e-mail or use enquiry form available on the website provided by the service provider or other methods specified by the service provider.

9.  Applicable law and jurisdiction

Terms and conditions is governed by Thai law and any legal actions regarding disputes arisen from the service or disputes between the user and the service provider over the service will be subject to the jurisdiction of the court of Thailand.
